OIR Rule Hearing

The Florida Department of Financial Services, Office of Insurance Regulation (“OIR”) has issued a Notice of Development of Rulemaking regarding the following Rule Chapter:

  • 69O-156:  Medicare Supplement Insurance

Proposed Rule updates to this Chapter will be considered to allow for new product generation through the adoption of revisions to the corresponding National Association of Insurance Commissioners Model Regulation.

If requested in writing and not deemed unnecessary by the agency head, a Rule development workshop will be held at the date, time and place shown below:

Department of Financial Services Rule Hearing

The Florida Department of Financial Services, Division of Consumer Services has issued a Notice of Proposed Rule regarding the following Rule relating to the My Safe Florida Home (“MSFH”) program:

The proposed Rule would implement the MSFH program by establishing a procedure for applying for a free wind inspection, the criteria for eligible homeowners, and the information required in the inspection report provided to the homeowner.

NAIC Accident and Health Working Group meeting

The National Association of Insurance Commissioners (“NAIC”) Accident and Health Group will meet via teleconference on Monday, May 18, starting at 2:00 p.m. (EST). The registration call-in number is:  412.317.6715.  Items scheduled to be discussed include the Medicare Supplement Compliance Manual and Statutory Accounting Principles Working Group referrals.

 

FHCF Rule Hearing

The Florida State Board of Administration, Florida Hurricane Catastrophe Fund (“FHCF”) has issued a Notice of Proposed Rule regarding the following Rule:

  • 19-8.028: Reimbursement Premium Formula

The proposed amended Rule would establish the FHCF Reimbursement Premium Formula and adopt the 2009-2010 contract year rates.

Note:  This hearing was originally scheduled to be held on March 27, 2009.

The Florida Commission on Hurricane Loss Projection Methodology (“FCHLPM”) will hold a meeting on Tuesday, May 19, 10:00 a.m.-6:00 p.m., in the Hermitage Conference Room, Room 116, 1801 Hermitage Blvd., Tallahassee.  The call in number for the meeting is:  888.808.6959; conference code:  4765251363.

Note:  The FCHLPM meetings originally scheduled to be held on Wednesday, May 20 and Thursday, May 21, have been rescheduled for Tuesday, June 2, and Wednesday, June 3.

 

U.S. House Financial Services Subcommittee on Capital Markets, Insurance and Government Sponsored Enterprises Hearing

The U.S. House Financial Services Subcommittee on Capital Markets, Insurance and Government Sponsored Enterprises will hold a hearing entitled “Approaches to Improving Credit Rating Agency Regulation” on Tuesday, May 19, 2:00 p.m., in Room 2128, Rayburn House Office Building, Washington, DC.  A live webcast of the hearing may be viewed by clicking here.

The Florida Department of Financial Services, Office of Insurance Regulation (“OIR”) has issued a Notice of Rulemaking Development regarding the following Rule relating to insurer claims reporting requirements:

  • 69O-142.015:  Standardized Requirements Applicable to Insurers After Hurricanes or Natural Disasters

The proposed Rule would adopt standardized reporting requirements that may be applied to insurers as a consequence of a hurricane or other natural disaster.  The purpose of the workshop is to develop Rule revisions that would incorporate updated information with respect to claims reporting requirements, and to clarify the format of the required information.

Amendments proposed to these Rules include:

  • The establishment of Rules for pooling of cancer claims;
  • The prohibition of an insurer from knowingly pricing an individual rate excessively; and
  • The further restriction of requirements for rate certifications to ensure the verity of annual rate filings.

Florida Department of Financial Services Rule Hearing

The Florida Department of Financial Services, Division of Consumer Services has issued a Notice of Proposed Rule regarding the following Rule:

  • 69J-166.002: Mediation of Commercial Residential Property Insurance Claims

The proposed Rule would establish a mediation program for resolving disputed commercial residential insurance claims to be administered by the Florida Department of Financial Services.  This Rule would replace Rule 69J-2.002, F.A.C., which is no longer needed, since the number of disputed commercial residential insurance claims being mediated through outside vendors has diminished significantly.  The proposed Rule creates procedures for a notice of the right to mediation, requesting mediation, assignment of mediators, payment for mediation, scheduling mediation conferences, and the conduct of the mediation conference.

The Florida Department of Financial Services, Office of Insurance Regulation has issued the attached Notice of Proposed Rulemaking regarding proposed changes to its annual and quarterly insurer reporting requirements and the update of the adopted 2008 National Association of Insurance Commissioners (“NAIC”) Financial Examiners Handbook to the 2009 version.

Amendments to the following Rules will be considered:

  • 69O-137.001:  Annual and Quarterly Reporting Requirements
  • 69O-138.001:  NAIC Financial Examiners Handbook Adopted

OIR Rule Hearing

The Florida Department of Financial Services, Office of Insurance Regulation (“OIR”) has issued a Notice of Proposed Rulemaking regarding the following Rule:

  • 69O-164.040: Determining Reserve Liabilities for Preneed Life Insurance

The original purpose of the proposed Rule was to recognize the inadequacy of the National Association of Insurance Commissioners (“NAIC”) 2001 Commissioners Standard Ordinary Life Valuation Mortality Table for use in determining the minimum standard of valuation and the minimum standard non-forfeiture value, and to require the continued use of the 1980 Commissioners Standard Ordinary Life Valuation Mortality Table for use in determining those standards.  After reviewing revisions to the NAIC model regulations, the OIR is recommending addition of Rule 69O-164.040 to the Florida Administrative Code.

Originally proposed for adoption in November 2008, the Rule now will be considered at a rescheduled hearing on June 16, 2009.
