NAIC Summer 2009 National Meeting
The National Association of Insurance Commissioners (“NAIC”) will hold its Summer 2009 National Meeting on Saturday, June 13, through Tuesday, June 16, at the Minneapolis Convention Center, Minneapolis. To view the meeting preview, click here.

- The Suitability of Annuity Sales Working Group meeting scheduled to be held on Sunday, June 14, from 8:00 a.m.-9:30 a.m. has been CANCELED.
- The Catastrophe Reserve Working Group meeting scheduled to be held on Sunday, June 14, from 3:00-4:00 p.m. has been CANCELED.

Citizens Claims Committee Meeting

OIR Rule Hearing
The Florida Department of Financial Services (“DFS”), Office of Insurance Regulation (“OIR”) has issued a Notice of Proposed Rulemaking regarding the following Rule:
- 69O-164.040: Determining Reserve Liabilities for Preneed Life Insurance
After reviewing revisions to the NAIC model regulations, the OIR recommends adding the Rule to the Florida Administrative Code. The original purpose of the proposed Rule was to recognize the inadequacy of the NAIC 2001 Commissioners Standard Ordinary Life Valuation Mortality Table for use in determining the minimum standard of valuation and non-forfeiture value, and to require the continued use of the 1980 Commissioners’ Standard Ordinary Life Valuation Mortality Table for use in determining those standards.

DFS Rule Hearing
The DFS Division of Agent and Agency Services has issued a Notice of Proposed Rulemaking regarding the following Rule:
- 69B-162.011: Suitability and Disclosure in Annuity Contracts-Forms Required
The proposed Rule would adopt an Annuity Suitability Form and a Disclosure and Comparison Form to be used when an insurance agent sells an annuity to a senior consumer.

U.S. House Hearing on Systemic Risk and Insurance
The U.S. House Financial Services Subcommittee on Capital Markets, Insurance, and Government Sponsored Enterprises has scheduled a hearing entitled “Systemic Risk and Insurance” for June 16, 2009 at 10:00 a.m. in Room 2128 of the Rayburn House Office Building, Washington, D.C. The hearing also will be available live via webinar here.
OIR Rule Hearing
The OIR has issued a Notice of Proposed Rulemaking regarding the following Rules:
- 69O-163.0075: Term and Evidence of Insurance
- 69O-163.009: Determination of Reasonableness of Benefits in Relation to Premium Charge
- 69O-163.011: Credit Disability Insurance Rates
The section of Florida law relating to credit life and credit disability insurance is being amended to address statutory changes contained in House Bill 343, which Florida Governor Charlie Crist signed into law on May 28, 2008.

DFS Rule Hearing
The DFS Division of Agents and Agency Services issued a Notice of Proposed Rulemaking regarding the following Rules relating to insurance agent continuing education compliance:
- 69B-228.030: Definitions
- 69B-228.220: Licensee Compliance; Requirements; Penalties for Non-Compliance
The proposed Rule amendments would delete the term “satellite,” thereby allowing continuing education courses that would have fallen into that category to be subject to the same compliance standards as other similar courses. A definition of “printed material” is added to allow for electronic text documents, provided they are readily printable. Rule 69B-228.220 is amended to require public adjusters to complete their continuing education in public adjuster courses.

DFS Rule Hearing
The DFS Division of Consumer Services has issued a Notice of Development of Rulemaking regarding the following Rule:
- 69J-123.002: Procedures
The proposed Rule amendment would resolve the problem of paper document processing by requiring all material filed with the DFS relating to a civil remedy action, such as the insurer’s report of disposition and other communications, be filed electronically. The civil remedy notice is already required to be filed electronically.

DFS Rule Hearing
The DFS Division of Workers’ Compensation has issued a Notice of Proposed Rulemaking regarding Rule Chapter 69L-5: Rules for Self-Insurers Under the Workers’ Compensation Act.
Rule Chapter 69L-5 is being amended to concurrently repeal and replace all existing Rules with new Rules that have been restructured and renumbered to clarify the workers’ compensation statutory compliance process used by self-insured employers.

DOR Rule Hearing
The Florida Department of Revenue (“DOR”) Miscellaneous Tax Division has issued a Notice of Proposed Rulemaking regarding the following Rule:
- 12B-8.001: Premium Tax; Rate and Computation
The purpose of the proposed Rule amendments is to:
- Update the Rule provisions to include self-insurance funds that are subject to the insurance premium tax;
- Provide for salary tax credit exceptions;
- Incorporate information on the Florida Life and Health Insurance Guaranty Association Assessment;
- Incorporate references to Section 624.5092, F.S.; and
- Provide technical corrections, including the update of statute references, expiration dates and references, and remove obsolete provisions.

The purpose of the proposed Rule amendments is to reflect changes and updates to forms, reference materials, electronic data interchange requirements, and billing instructions for providers and insurers associated with adoption of revised workers’ compensation medical services manuals.

DFS Rule Hearing
The DFS Division of Workers’ Compensation has issued a Notice of Proposed Rulemaking regarding the following Rule:
- 69L-7.501: Florida Workers’ Compensation Reimbursement Manual for Hospitals
The purpose of the proposed Rule amendments is to adopt the 2009 edition of the Florida Workers’ Compensation Reimbursement Manual for Hospitals. Among other updates, the 2009 manual incorporates Medicare’s Outpatient Hospital Prospective Payment System payment methodology for reimbursing hospitals for outpatient bills, with payment adjustment factors of 1.74 times the Medicare allowed amount for scheduled surgeries and 3.95 times the Medicare allowed amount for other specified compensable charges.
