OIR Rule Hearing–RESCHEDULED

The Florida Department of Financial Services, Office of Insurance Regulation has issued a Notice of Proposed Rule Development regarding the following Rule:

  • 69O-175.008: Unfair Discrimination in Private Passenger Motor Vehicle Insurance Rates – Based on History of Accidents

The proposed Rule seeks to clarify that it is a violation of Florida law for insurers to use not-at-fault accidents that occurred prior to a policyholder becoming covered by a particular insurer in determining the premium due.

OIR Rule Hearing

The Florida Department of Financial Services, Office of Insurance Regulation has issued a Notice of Rulemaking Development regarding the following Rule:

The purpose of the proposed Rule is to set forth details for any hearings requested by insurers as a result of disagreeing with findings in the draft version of the Florida Office of Insurance Regulation’s (“OIR”) examination report.  The amended Rule would clarify that, if the OIR takes action against an insurer based upon findings in the final version of the report, the insurer has the right to petition for a formal hearing to be held in front of the Florida Division of Administrative Hearings.
