Florida Department of Financial Services Rule Hearing

The Florida Department of Financial Services, Division of Insurance Agents and Agency Services has issued a Notice of Rulemaking Development regarding the following Rules relating to continuing education for insurance agents, adjusters and insurance educators:

Among other modifications, the proposed Rule amendments would require that public adjusters have their continuing education in public adjuster courses.

OIR Rule Hearing

The Florida Department of Financial Services, Office of Insurance Regulation (“OIR”) has issued a Notice of Proposed Rule regarding the following Rule:

  • 69O-164.040: Determining Reserve Liabilities for Preneed Life Insurance

The purpose of the proposed Rule is to recognize the inadequacy of the 2001 Commissioners Standard Ordinary Life Valuation Mortality Table for use in determining the minimum standard of valuation and the minimum standard non-forfeiture value, and to require the continued use of the 1980 Commissioners Standard Ordinary Life Valuation Mortality Table for use in determining those standards.

2009 PSC Hurricane Season Preparedness Workshop

The Florida Public Service Commission (“PSC”) will hold a 2009 Hurricane Season Preparedness Workshop on Wednesday, May 6, starting at 9:30 a.m. in the Betty Easley Conference Center, Room 148, 4075 Esplanade Way, Tallahassee.

The purpose of this workshop is to provide a forum for Florida’s electric utilities and local exchange companies to brief the PSC on their 2009 hurricane season preparation.

OIR Rule Hearing

The Florida Department of Financial Services, Office of Insurance Regulation (“OIR”) has issued a Notice of Proposed Rule regarding the following Rules:

  • 69O-163.0075: Term and Evidence of Insurance
  • 69O-163.009: Determination of Reasonableness of Benefits in Relation to Premium Charge
  • 69O-163.011: Credit Disability Insurance Rates

Proposed amendments to the Credit Life and Credit Disability Insurance Rule Chapter would address statutory changes in House Bill 343, which the Governor approved on May 28, 2008.  The bill removes the $50,000 requirement for credit life, but did not remove the 10-year limit that is still contained in Florida law.  Similarly, the bill removed the 10-year limit for credit disability, but did not remove the $50,000 limit that is still contained in Florida law.

NAIC Reinsurance Task Force Interim Meeting

The National Association of Insurance Commissioners (“NAIC”) Reinsurance Task Force will hold interim meetings on Wednesday, May 6, from 1:00 p.m.-5:00 p.m. and Thursday, May 7, from 9:00 a.m.-5:00 p.m. at the Grand Hyatt New York, 109 East 42nd Street at Grand Central Terminal, New York.

Workers’ Compensation Rule Hearing

The Florida Department of Financial Services, Division of Workers’ Compensation has issued a Notice of Proposed Rule regarding the following Rule:

  • 69L-6.028:  Procedures for Imputing Payroll and Penalty Calculations

The purpose of the proposed Rule amendment is to provide the Florida Department of Financial Services alternative means and methods by which it may calculate an employer’s imputed payroll and penalty, to clarify the time frame within which such imputation may occur, and to define the meaning of “non-compliance” within the meaning of the Rule.  Additionally, the proposed Rule amendment deletes language from the existing Rule regarding penalty assessments for periods of noncompliance that occurred prior to October 1, 2003.

Florida Cabinet Meeting

Florida Governor Charlie Crist and the Cabinet (“Cabinet”) will hold a meeting on Wednesday, May 13, starting at 9:00 a.m. in the Cabinet Meeting Room, Lower Level, The Capitol, Tallahassee.  The meeting agenda, which may be viewed by clicking here, includes insurance-related items regarding the Florida Hurricane Catastrophe Fund (“FHCF”) and recently-passed HB 1495:

  • A request for approval by the FHCF  to file Emergency Rule 19ER09-1, Reimbursement Contract, for adoption, along with its accompanying forms, upon CS/CS/CS/HB 1495 becoming law.  Specific reasons given by the State Board of Administration for filing the Rule including finding an immediate danger to the public, health, safety or welfare:  The 2009 Legislature passed CS/CS/CS/HB 1495, with an effective date of June 1, 2009.  This legislation affects the Reimbursement Contract and specifically impacts the type and level of optional coverages provided under the Contract. The contract year begins on June 1, 2009; therefore, emergency rulemaking is necessary.
  • A request for approval for the FHCF to file a Notice of Proposed Rulemaking to amend Rule 19-8.010, F.A.C., Reimbursement Contract, to incorporate those changes made in Emergency Rule 19ER09-1 once the Emergency Rule has been filed and has become effective, and, if no member of the public requests a rule hearing, a request for approval to file this Rule and its forms for adoption.

The Florida Department of Financial Services, Office of Insurance Regulation (“OIR”) has issued a Notice of Proposed Rule regarding the following Rule relating to health insurance:

The purpose of the proposed Rule amendment is to provide amended standard risk rates for indemnity insurance plans.

The Florida Department of Financial Services, Division of Consumer Services has issued a Notice of Proposed Rule regarding the following Rule relating to the My Safe Florida Home (“MSFH”) program:

The proposed Rule would implement the MSFH program by establishing a procedure for applying for a free wind inspection, the criteria for eligible homeowners, and the information required in the inspection report provided to the homeowner.

The Florida State Board of Administration has issued a Notice of Proposed Rule regarding the following Rule:

  • 19-8.028: Reimbursement Premium Formula

The proposed amended Rule would establish the Florida Hurricane Catastrophe Fund (“FHCF”) reimbursement premium formula and adopt the 2009-2010 contract year rates.

Note:  This hearing was originally scheduled to be held on March 27, 2009.

Proposed Rule updates to this Chapter will be considered to allow for new product generation through the adoption of revisions to the corresponding National Association of Insurance Commissioners Model Regulation.

Amendments proposed to these Rules include:

  • The establishment of Rules for pooling of cancer claims;
  • The prohibition of an insurer from knowingly pricing an individual rate excessively; and
  • The further restriction of requirements for rate certifications to ensure the verity of annual rate filings.

Florida Department of Financial Services Rule Hearing

The Florida Department of Financial Services, Division of Consumer Services has issued a Notice of Proposed Rule regarding the following Rule:

  • 69J-166.002: Mediation of Commercial Residential Property Insurance Claims

The proposed Rule would establish a mediation program for resolving disputed commercial residential insurance claims to be administered by the Florida Department of Financial Services.  This Rule would replace Rule 69J-2.002, F.A.C., which is no longer needed, since the number of disputed commercial residential insurance claims being mediated through outside vendors has diminished significantly.  The Rule creates procedures for a notice of the right to mediation, requesting mediation, assignment of mediators, payment for mediation, scheduling mediation conferences, and the conduct of the mediation conference.
