Florida Insurance Consumer Advocate Claims Dispute Resolution Roundtable

Florida Agency for Health Care Administration Rule Hearing-Health Facility and Agency Licensing

The Florida Agency for Health Care Administration, Division of Health Facility and Agency Licensing has issued a Notice of Proposed Rule regarding proposed Rule Chapter 59A-35, entitled “Health Care Licensing Procedures.”

The proposed Rule Chapter is being developed to establish licensure requirements, application procedures and administrative proceedings for all health care providers licensed by the Agency for Health Care Administration.

Florida Agency for Workforce Innovation Rule Hearing-Professional Employer Organization Reporting Requirements

The Florida Department of Management Services, Agency for Workforce Innovation has issued a Notice of Proposed Rule regarding the following Rule:

  • 60BB-2.025: Reports Required of Liable Employers; Filing of Reports by Electronic Means

The proposed Rule would conform sections of the existing Rule to amendments made by the 2009 Florida Legislature to Section 443.1216, F.S.  The proposed Rule describes quarterly reporting requirements for certain employers and prescribes filing methods.  It also incorporates the reporting format required by the United States Department of Labor’s Bureau of Labor Statistics for its Multiple Worksite Report for Professional Employer Organizations.

DFS Rule Hearing-Sinkhole Database

The Florida Department of Financial Services (“DFS”), Division of Consumer Services has issued a Notice of Proposed Rule regarding the following Rule:

  • 69J-9.001: Database of Information Relating to Sinkholes

The DFS is required by law to consult with the Florida Geological Survey and the Florida Department of Environmental Protection to implement a statewide electronic database of sinkholes and related activity. 

If adopted, the proposed Rule would provide the form and content of the database, which may include:  standards for reporting and investigating sinkholes, requirements for insurers to report the receipt of sinkhole claims, past sinkhole claim activity and ground settling-related information.

SBA Rule Workshop-FHCF 2010 Reimbursement Contract and Reporting Requirements

The Florida State Board of Administration (“SBA”) has issued a Notice of Rulemaking Development regarding the following Florida Hurricane Catastrophe Fund (“FHCF”) Rules:

  • 19-8.010: Reimbursement Contract
  • 19-8.012: Procedures to Determine Ineligibility for Participation in the Florida Hurricane Catastrophe Fund and to Determine Exemption from Participation in the Florida Hurricane Catastrophe Fund due to Limited Exposure
  • 19-8.013: Revenue Bonds Issued Pursuant to Section 215.555(6), F.S
  • 19-8.028: Reimbursement Premium Formula
  • 19-8.029: Insurer Reporting Requirements
  • 19-8.030: Insurer Responsibilities

Proposed amendments to the existing Rules would relate to the FHCF Reimbursement Contract, as well as to FHCF insurer exemption and ineligibility, bonding for revenue generation, reimbursement premium formula requirements, insurer reporting requirements and insurer responsibilities for the 2010 FHCF contract year.
