INSURANCE REGULATORY MEETINGS
Monday, January 11
2010 Florida Health Care Summit
Florida Insurance Commissioner Kevin McCarty will be a featured speaker at the 2010 Florida Health Care Summit on Monday, January 11, 2010 that will focus on federal health insurance legislation as it relates to Florida.
Participants in the four scheduled Summit panel discussions will include representatives from major insurance carriers and health care providers, representatives from Florida’s agent and businesses communities, as well as elected and regulatory officials. Television news reporter Mike Vasilinda, whose wife is a Florida House Representative, will moderate the event. Other participants include the Florida Medical Association, the American Association of Retired Persons (AARP), Florida Senator Don Gaetz and Florida Insurance Consumer Advocate Sean Shaw.

DFS Rule Hearing-Sinkhole Database
The Florida Department of Financial Services (“DFS”), Division of Consumer Services has issued a Notice of Proposed Rule regarding the following Rule:
- 69J-9.001: Database of Information Relating to Sinkholes
The DFS is required by law to consult with the Florida Geological Survey and the Florida Department of Environmental Protection to implement a statewide electronic database of sinkholes and related activity.
If adopted, the proposed Rule would provide the form and content of the database, which may include: standards for reporting and investigating sinkholes, requirements for insurers to report the receipt of sinkhole claims, past sinkhole claim activity and ground settling-related information.
If a Rule Hearing is requested in writing and not deemed unnecessary by the agency head, one will be held at the date, time, and place shown below:

SBA Rule Workshop-FHCF 2010 Reimbursement Contract and Reporting Requirements
The Florida State Board of Administration (“SBA”) has issued a Notice of Rulemaking Development regarding the following Florida Hurricane Catastrophe Fund (“FHCF”)-related Rules:
- 19-8.010: Reimbursement Contract
- 19-8.012: Procedures to Determine Ineligibility for Participation in the Florida Hurricane Catastrophe Fund and to Determine Exemption from Participation in the Florida Hurricane Catastrophe Fund due to Limited Exposure
- 19-8.013: Revenue Bonds Issued Pursuant to Section 215.555(6), F.S
- 19-8.028: Reimbursement Premium Formula
- 19-8.029: Insurer Reporting Requirements
- 19-8.030: Insurer Responsibilities
Proposed amendments to the existing Rules would relate to the FHCF Reimbursement Contract, as well as to FHCF insurer exemption and ineligibility, bonding for revenue generation, reimbursement premium formula requirements, insurer reporting requirements and insurer responsibilities for the 2010 FHCF contract year.
If a Rule Development Workshop is requested in writing and not deemed unnecessary by the agency head, one will be held at the date, time, and place shown below:

Florida Division of Agent and Agency Services Rule Workshop–Penalty Guidelines for Insurance Representatives
The Florida DFS, Division of Agent and Agency Services has issued a Notice of Proposed Rulemaking regarding proposed updates to regulations governing the license suspension and revocation of insurance adjusters, agents, customer and service representatives.
The following Rules would be amended:
- 69B-231.030: Definitions
- 69B-231.080: Penalties for Violation of Section 626.611
- 69B-231.100: Penalties for Violation of Subsection 626.9541(1)
- 69B-231.110: Penalties for Violation of Other Specific Provisions of the Florida Insurance Code
- 69B-231.160: Aggravating/Mitigating Factors
The amendments would add regulations recently adopted by the Florida Legislature and delete laws that have been repealed. The penalties for violating certain laws also would be increased to reflect the Florida Department of Financial Services’ experience in dealing with the frequency and severity of these violations.
