Budget Bills Containing Insurance Fraud Prosecutor Funding, Workers’ Comp Repackaged Medication Reimbursement Allowance Sent to Governor Crist on May 13, 2010

Florida Governor Charlie Crist was presented with 63 bills on May 13, 2010, among which included HB 5001 relating to Appropriations and HB 5603.  Both bills contain provisions relating to insurance.

The Governor has until Friday, May 28, 2010 to sign, veto, or let these bills to become law without his signature. 

 

State Budget

Also known as “The 2010-2011 General Appropriations Act” (“State Budget”)  HB 5001 includes an appropriation to fund various full-time insurance fraud prosecutor positions throughout Florida.  

Additional funds are included for specific prosecution of workers’ compensation insurance fraud, together with other funds dedicated to the prosecution Personal Injury Protection insurance fraud cases in Duval, Orange, Miami-Dade, Hillsborough, Palm Beach and Broward counties.  This money may not be used for any purpose other than the funding of positions and activities that prosecute crimes of insurance fraud.

HB 5603

HB 5603 relating to the Florida Department of Financial Services by the Government Operations Appropriations Committee and State Representative Alan Hays (R-Umatilla) would, among other provisions, revise the maximum reimbursement allowances section in 440.13, F.S. for the purpose of addressing the increased costs of repackaged medications. 

The bill was amended during budget conference negotiations late in the 2010 Session and subsequently passed on April 30, 2010.   To view a copy of HB 5603, click here.
