Board of Employee Leasing Companies Meeting Report: July 15

On Wednesday, July 15, 2009, the Board of Employee Leasing Companies (“Board”) met to consider employee leasing company applications, controlling person applications and de minimis exemption and registration applications.
The following employee leasing company and controlling person applications were approved:
- Howard Leasing, Inc. – employee leasing company application
- Charles J. Howard and Charles P. Howard, Howard Leasing II, LLC – controlling person applications
The de minimis exemption and registration application for A-Plus Benefits, Inc. was approved by the Board. The associated controlling person applications for Richard L. Bartholomew, John Bartholomew and Brenda J. Wright were withdrawn, because controlling persons are not required for de minimis companies.
During discussion on the de minimis exemption and registration application for The Hancock Management Group, LLC, Board members expressed concern about receiving proof of workers’ compensation coverage for any Hancock employees who are Florida residents. It was explained by Board Vice Chairman Abram Finkelstein that de minimis companies are exempt from the type of proof of insurance requirements imposed on other licensed companies and are not required to file quarterly reports. By definition, a de minimis company should not have any Florida-based clients, but Florida resident workers are permitted. The Board approved the application.
The deficient employee leasing company applications for Employers Consortium V, Inc. and Versatech Consulting, Inc. were denied. The deficient employee leasing company application for DHR III, Inc. was withdrawn, because the company already operates under a de minimis license and the application was filed in error.
The meeting was then adjourned.
