Attorney-Client Privileged Memorandum: For Immediate Consideration By FPCA Members–Florida State Board of Administration Requests Production of Documents in Sunshine State Matter

Pursuant to the Florida Property and Casualty Association (“FPCA”)’s request for legal advice on the Sunshine State Insurance Company (“Sunshine State”) dispute with the Florida State Board of Administration (“SBA”) regarding the 2005-2006 Florida Hurricane Catastrophe Fund (“FHCF”) Reimbursement Contract, the attached memorandum is being provided to the FPCA. This e-mail and the accompanying information are subject to the attorney-client privilege.
The memorandum details a specific request for certain information made by the SBA to Sunshine State in the ongoing Sunshine State/SBA litigation concerning whether an insured’s attorney fees, public adjuster costs and other similar expenses are covered losses under the 2005-2006 FHCF Reimbursement Contract. A copy of the SBA’s request for production of documents is attached.
This e-mail and the memorandum should not be distributed outside of the FPCA in order to preserve the attorney-client privilege.
