Amendment Filed to SB/CS 2338 Would Revise Maximum PIP Reimbursements

Apr 14, 2008

A strike-all amendment regarding personal injury protection benefits has been filed by Senator Victor Crist to Senate Bill/Committee Substitute 1 2338.

SB/CS 1 2338, sponsored by Senator Dave Aronberg, is scheduled to be heard by the Senate Commerce Committee on April 15.

Senator Crist’s amendment, a copy of which is attached for your review, revises the schedule of maximum charges on which any insurer may base a limited reimbursement for certain medical services, supplies, and care for injured persons covered by personal injury protection. The amendment also specifies a minimum amount for the applicable fee schedule or payment limitation under Medicare for such reimbursements. The amendment also has stricken provisions increasing the renewal notice requirement.

The Senate Banking and Insurance Committee initially amended SB 2338 on April 8.

We will continue to monitor developments regarding SB 2338 and provide reports on the proceedings.
