Amended Public Adjuster Bill Passes Policy & Budget Council

The House Policy and Budget Council considered, amended and passed House Bill 661 today, April 21, 2008. The amendment, which was handwritten, removed the requirement that public adjusters subject themselves to examinations under oath.
The provisions of HB 661 relate to and revise certain provisions of law regulating public adjusters relating to suspended license application reinstatement filing fees; examination exemptions for specified adjusters seeking reinstatement of suspended licenses; required examinations; prohibitions against soliciting or entering into contracts with insureds or claimants under insurance policies; client cancellation of public adjuster’s contract to adjust claim without penalty; unfair and deceptive insurance trade practices; prohibitions against giving or offering monetary loan or article in excess of specified value to clients or prospective clients, public adjusters basing charges, fees, payments, commissions, or compensation relating to supplemental claim on the corresponding previous settlement or claim payment or charging, agreeing to, or accepting fees, payments, commissions, or compensation in excess of specified amounts; required public adjuster examinations for license after period of suspension, termination, cancellation, revocation, or expiration; requirements and limitations for licensure and practice as public adjuster apprentice; continuing education requirements for specified adjusters; satisfaction of continuing education requirements for nonresident adjusters; disciplinary guidelines for public adjusters and apprentices; requirements for reinstatement of suspended licenses, appointments, or eligibility; requirements and limitations for nonresident public adjuster licensure; specified contracts containing specified statement regarding fraud.
The bill, now having passed both of its committees of reference, is ready for consideration by the full House.
