After Withdrawing Strike-Everything Today, State Representative Proctor Files Four Amendments to SB 2044
Apr 27, 2010
After withdrawing his strike-everything amendment to SB 2044 today, April 27, State Representative Bill Proctor plans to file four amendments to the bill tomorrow, April 28.
- Florida Property and Casualty Association Member review and feedback is requested on the amendments. Send all comments to Katie Webb (kwebb@cftlaw.com) at Colodny Fass at the earliest convenience.
At this time, it is expected that these amendments will be offered when SB 2044 is on third reading tomorrow, and that other amendments will be regarded as unfriendly by the bill presenter, Representative Proctor.
Essentially, these four amendments effect the following:
- Requires insurers to report the street address for sinkhole claims to Florida’s Sinkhole Database;
- Extends the prohibition on use and file rates for six months;
- Allows for an insurer to use a preferred vendor when quoting prices for replacement costs on dwelling repairs; and
- Removes the reference in SB 2044 to the Valued Policy Law in regard to payment for replacement cost value on dwellings.
Other amendments are expected to be filed to SB 2044. In particular, one would serve to remove the three-year limit on filing claims after a hurricane.
