Florida Property and Casualty Association Homeowners Division Members:

A special FPCA Homeowners Division meeting is scheduled for Monday, April 21, 2014 at 9:30 a.m.  The conference call number:  800.369.1285; conference code: 7468537#

The 2014 Session is coming to a close, with only the final two weeks of floor deliberations left before adjournment on May 2nd.  The FPCA has one major issue left on the table.

The CFO’s Homeowners’ Bill of Rights legislation, HB 743, is out of committee and available for consideration on the House floor. The companion legislation, SB 708, is on the Senate Special Order Calendar for consideration on the Senate floor on Wednesday, April 23rd.

At this time, both bills include provisions that define and restrict “emergency mitigation service” agreements. Specifically, under subsection 2(a) of Section 9 of HB 743 and Section 10 of SB 708, an emergency mitigation services agreement is only valid if it complies with the policy’s managed repair provisions, among other restricting provisions.
