2008 Regular Florida Legislative Session Concludes

May 2, 2008

At 6:02 p.m., May 2, 2008, the 2008 Regular Florida Legislative Session adjourned Sine Die.

Several insurance-related bills passed, including the following:

  • CS/SB 2860/1196: Relating to Property Insurance, which includes property insurance reform measures regarding the following:
    • The Insurance Capital Build Up Program
    • Market Conduct Exams, Filing of Claims Handling Practices with the Florida Office of Insurance Regulation
    • Administrative Fines in Lieu of Suspension or Revocation of License
    • Trade Secret Documents
    • Residential Nonrenewals
    • Penalties for Unfair Insurance Trade Practices
    • Unfair Insurance Trade Practices
    • Administrative Proceedings in Rate Determinations
    • Rate Standards
    • The Florida Commission on Hurricane Loss Projection Methodology
    • Residential Property Rate Filings
    • Citizens Property Insurance Corporation
  • CS/SB 2012: Relating to Insurance Policies, which became an insurance train late in Session including important provisions applicable to insurance
  • HB 7103, Comparable to SB 644: Relating to Mitigation

A comprehensive summary of all of the bills we have been tracking during the 2008 Regular Legislative Session will be circulated shortly.

Florida Governor Charlie Crist issued a statement lauding the Florida Legislature for its ability to ensure the public safety, and quality education, to care for Florida’s most vulnerable citizens and also to protect and preserve Florida’s natural resources, despite having decreased revenue to work with.

“I want to thank Senate President Ken Pruitt and House Speaker Marco Rubio – as well as their budget leaders, Senator Lisa Carlton and Representative Ray Sansom – for their commitment to addressing the needs of Floridians during this challenging and historic time,” Governor Crist said. “It is easier to legislate and govern when funds are flowing in, but they have done a tremendous job focusing on the needs of the people of Florida and building a budget that ensures a bright future for Florida.”
